1.Who we are

"Painless AI," "we," "us," and "our" refer to Painless AI, an AI consulting service operating at painlessai.us. We help people and businesses use AI without having to learn it, keep up with it, or run it themselves. "You" and "your" mean the person or business using our website or services.

2.Our services

We provide AI advisory, recommendations, setup, automations, custom builds, and ongoing support, offered through memberships, project work, and consultations. The specifics of any engagement, including scope, deliverables, timing, and fees, are agreed with you before work begins. We may update, add, or discontinue parts of our services over time.

3.Eligibility

You must be at least 18 years old and able to enter into a binding agreement. If you use our services on behalf of a business, you confirm that you are authorized to accept these terms for it.

4.Memberships, fees, and billing

• Membership plans are billed on a recurring basis (for example, monthly) at the price shown or quoted to you. Project work is billed at the fixed or ranged price agreed in advance.
• You can cancel a membership at any time. Cancellation stops future charges; it does not refund the current period unless we say otherwise in writing.
• Unless stated otherwise, fees are non refundable once the work or service period has begun.
• Prices shown on our website may change. Any change to your recurring price will be communicated before it takes effect.

5.Consultations and scheduling

Consultations may be booked through our scheduling provider. Please give reasonable notice if you need to reschedule or cancel. Repeated missed appointments may affect availability.

6.Your responsibilities

• Give us accurate information and timely access to anything we need to do the work.
• Review outputs, drafts, and automations before you rely on them or send them to others.
• Keep your own account credentials and access secure.
• Use our services and any deliverables lawfully and in line with these terms.

7.AI outputs and no professional advice

Our work often involves AI tools that generate text, code, images, and other content. AI can be wrong, incomplete, or outdated, and outputs can vary. We do our best to deliver useful, accurate results, but you are responsible for reviewing and approving anything before it is used.

Nothing we provide is legal, financial, medical, tax, or other regulated professional advice. If you need that, please consult a licensed professional.

8.Third party tools and services

Delivering our services often means using third party platforms, including AI providers and other software. Those providers have their own terms and privacy practices, and your use of what we set up may be subject to them. We are not responsible for third party services, their availability, or changes they make.

9.Intellectual property

Unless we agree otherwise in writing, final deliverables we create specifically for you become yours once fully paid for. We retain ownership of our own pre existing materials, tools, templates, methods, and know how, and of anything on this website, including the Painless AI name, logo, and brand. You may not copy or reuse our brand or site content without permission.

10.Confidentiality

We treat the non public information you share with us as confidential and use it only to provide our services. You agree to do the same with any non public information we share with you.

11.Acceptable use

You agree not to use our services to break the law, infringe others' rights, send spam, distribute malware, or attempt to disrupt or gain unauthorized access to any system. We may suspend or end service for misuse.

12.Disclaimers

Our website and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non infringement. We do not warrant that our services will be uninterrupted, error free, or that any specific result or business outcome will be achieved.

13.Limitation of liability

To the fullest extent permitted by law, Painless AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to our services will not exceed the amount you paid us for the services giving rise to the claim in the three months before the claim arose.

14.Indemnification

You agree to indemnify and hold Painless AI harmless from claims, losses, and expenses arising from your misuse of our services, your content, or your breach of these terms.

15.Termination

You may stop using our services at any time. We may suspend or end your access if you breach these terms or if we discontinue a service. Sections that by their nature should survive termination, such as intellectual property, confidentiality, disclaimers, and limitation of liability, will survive.

16.Changes to these terms

We may update these terms from time to time. When we do, we will change the "last updated" date above. Continued use of our services after an update means you accept the revised terms.

17.Governing law

These terms are governed by the laws of the United States and the state in which Painless AI is established, without regard to conflict of law rules. Any dispute will be handled in the courts located there, unless applicable law requires otherwise.
